Permanent Residency status - effective date?

Is the permanent residency effective from the date it is registered by USCIS after the approval of I-485 or from the time we receive the actual green card. Is the person eligible to start working right away based on the notice or need to wait to receive the card? This is important to know whether we...

TN - good news

The validity for TN is going to change from 1 year to 3 years meaning that you don't need to renew every year but every 3 years, just like H1.

AP question

Do we have to be on a job, when we return after travel abroad on Advance Parole, while the I-485 is pending and the TN has expired?

Thanks for the response.

Thanks for the valuable advise Nelsona! I did discuss the issue with CRA. The CRA rep. herself was surprised that there was no credit given and advised me to file T1-ADJ. You were right about W-2 and 1040. I got another question. In order to claim Ontario provincial credits for 2006, should I have b...

Since W-2 does not show a breakdown of taxes for the portion of the year (Jan-Mar), I sent a copy of the Pay check upto that period that clearly shows all the taxes paid. I believe the anwer is YES to my previous question. Should I call CRA and discuss? I can provide the copy of the W-2 if requested...

Foreign Tax Credit?

Hi, Am I eligible for Foreign Tax Credit in Canadian Return? The scenario: I moved to the US from Canada in March 2006 and I filed the Canadian return declaring all my US income up until March 2006 claiming foreign tax credit for the taxes I paid in the US. In my notice of Assessment no credit is gi...

Mandatory Depreciation of Rental Property

Would any one explain how the Mandatory depreciation is calculated.
For rental property, is it based on before and after renting or based on the original purchase price and the current value?

Thanks for the response.

So what would be my classification for filing the taxes in Canada, non-resident? Here is the situation. I started working here in the US from July 2005 on TN while my family stayed back in Canada. Moved my family in March 2006.We didn't have any income from Canadian sources until March. We rented ou...

Thanks Nelsona for the response. I rented out the condo only in May last year and still have my credit card/bank accounts. I thought simply having a property (even the rented one) in Canada will make you a Canadian resident for tax purpose and therefore you need to file T1 and declare world income. ...

Moving Expenses

It is disappointing to know that you cannot claim moving expenses in T1 for moving from Canada to the US while keeping residential ties in Canada. I moved last year but renting out my Condo. I guess I can claim in my 2007 return if I sell the property this year. Has anybody gone through this before?...

US-Canada Income Tax Advise Needed

Hello everyone, I am new to this forum and would like to get some advise on US-Canada income tax issues. I am a Canadian citizen working in the US on TN. I think I should fill form 1040 in US and T1 in Canada. Am I right? Apparently, I am a resident of US (after the substantial presence test) What a...
