The employer has to sponsor you for an appropriate immigration status. You will need an immigration status that allows you to work in the US. Without knowing what the job is, we have no way of knowing what status would be appropriate. Without knowing more about you, your education and your experienc...

[quote="nelsona"] And the test you are referring to is the Substantial presence test not the Green card test. She was allowed to file 1040NR, and I told her just that. The reason she should have filed 1040 is (a) because she is allowed to by IRS rules (it's called the first-year choice) an...

LOL... forum shopping. That's almost as bad as POE shopping. This exchange reminds me a bit of one on the old Grasmick forum: the H1 who was switching to a TN job and insisted that she was going to get TN and then give 2 weeks notice at H1 job... refused to believe she couldn't have both H1 and TN s...

Nobody has to come up with any strong arguments for you. I didn't sponsor anybody for Canadian PR, you did. If you don't like the rules, that's your business. When your wife formally activates her PR visa and "lands" in Canada, she is going to be asked a number of questions. There is nothi...

What is the basis for her Permanent Residence in Canada? Did you sponsor her as a family member, or did she apply on her own?

Canuck, there are 50 states, hence 50 sets of rules for how new residents get driver's licenses. Check the State of Michigan's web site for links to their Motor Vehicle dept, and look for the "new residents" link. You will find out what MI requires. Even if they let you keep your ON licens...

Everything Nelson has said is correct. I would add that when he says "If you live in MI, you need MI DL..." you should read that to mean that those things are required by state law if you are a resident of MI. Every state has a time limit for getting fully converted, typically 30 days. You...

The rules for deriving citizenship from parents who naturalize are complex, and are described in the USCIS Guide to Naturalization. Questions 25 and 26 deal with this matter. A lot of important details are missing from your description of the situation, but if she was over 18 when the parents natura...

If you read the NAFTA TN handbook, it says nothing about maintaining Canadian ties while on TN status. However, there have been reports on some of the forums claiming that some POE officers have been hassling TNers about this. Renew your TN by mail to avoid border inspectors who are creatively inter...

It might be possible for you to establish a business in the USA; E2 is one of the visa categories for this. However, this route is not easy or fast. To echo Nelson's responses: there's no way this is a DIY project; you need a good lawyer with E2 experience; you can't operate your renovation/resale b...

The two of you must be married for her to qualify for TD status. Of course, if she qualifies for her own TN, then she could accompany you that way without marrying you. Keep in mind that she will not be able to work as a TD; she will be Totally Dependent on your income.

Karen, Cindi gave you the most complete answer. Realistically, as you have described your plan, you are several years away from completion. First, husband has to get GC. Second, three years in US as GC holder. Third, he must naturalize. Finally, he sponsors you as a spouse for permanent residency in...
