Re: Confused about T1243, T1244 and T1161
For US a gain only occurs upon sale. If you sold nothing before departure, there is no gain in US. If you sold something earlier in the year, before your departure date, AND you are filing a full year 1040, then yes, FTC will be the way to go. The gains ON SALES that occur after departure will be ta...

Re: Confused about T1243, T1244 and T1161
Ufile, and CRA have nothing to to with the Rev Proc. That is strictly dealt with IRS. Everything you report to CRA is basd on the day you left. If you sold even the next day after you left, you still need to report that you had them, and pay deemed disposition tax based on the day you left. Forget, ...

Re: Determine Canada (Deemed) Non-resident
You can *elect* to be treated as a non-resident of US, but I'm quite sure you would be better off tax-wise to file like a resident (ie. full year 1040).
I have given you my opinion on how to file.

Re: Determine Canada (Deemed) Non-resident
In my opinion, you have spent too much time in Canada to be considered non-resident -- deemed or otherwise. Tp be a deemed non-resident, you must satisfy TREATY definition of resident of US. By spending so much time in Canada with your spouse, (and child) you demonstrate that your centre of vital in...

Re: RRSP / Form 8833 / Publication 597
8833 was never required for RRSPs. the RRSP form was rendered obsolete in 2014, Previous to that various "statements" were attached to cover the account. As mentioned in 597, there is no longer any reporting requirement for accounts for which income is being deferred until withdrawal.

Re: Confused about T1243, T1244 and T1161
Dispositions made after departing Canada do not absolve you from reporting the deemed disposition of those assets on the day you left canada on the various forms. Ufile may not be handling those quite correctly, but realize that you cannot Netfile your return if you do not live in Canada, so you wil...

I'm quite sure that the software can handle SS income. Since you do not live in Canada, it must be reported.

Re: Do I need Last Will & Testament in both countries?
The very term "last will...", implies there is only one. It is best if it is drawn up in the jurisdiction that one currently lives in, and -- in you case -- would need to take into account any cross-border issues that you can foresee. But having two wills can easily be contested, especiall...

Re: TN/TD Visa Closer connection exception
The fact that you reside in California makes you a CDn non-resident, plain and simple. Where you and spouse reside overrides any financial ties in other countries.
File a departure return for 2024, and a full year 1040 and california return.

No. Physically moving and occupying a home in Ontario (which must be done before applying for OHIP in any case) establishes residency.
