[quote="nelsona"]Are you fairly confident that this preparer actually ran the numbers, or is he just unfamiliar with how the pro forma works? A good preparer would have run it both ways for you and show you. I find it hard to believe that, using the tax payments your husband made throughou...

Article XXV NOT be better than 1040NR?

Several years ago I filed my own taxes using a pro forma 1040 MFJ as a Canadian commuter working in the US. Fast forward 5 years & a couple of young kids (= no time ;)) & for the past few years I've used a tax preparer. This year, a new preparer tells me our situation does not benefit the us...

Thanks a lot nelsona! I think we'll wait and see and hope the funds reach $5k again in the near future. I guess if they really don't want to hold the money they'll just send us a check (reduced). Not a lot of options here anyway.

I appreciate the reponse(s).

So the taxes paid will be effectively the same as if he were earning a salary in the US? That seems odd.

Thanks nelsona.

This has happened twice before (threat to close when the balance dropped below $5k) but they kept it open once it passed that threshold again. We should have moved the money to a bond fund once it reached $5k. It'll be tough to get back above $5k in an equity fund in these markets!

Rolling over <$5k once back in Canada

My husband (Canadian citizen living in Canada) has a small 401k with a former employer when he was commuting to the US a few years back. The account was not originally rolled over to an IRA because it was >$5k. Now that the balance has fallen below $5k, JPMorgan is telling him that he needs to take ...

Thanks nelsona. It sounds like I just need to resend the package because I did send all the info as you mentioned. It's been awhile since I've looked at it but I'm quite certain I didn't miss anything. I submitted the same thing I did the year prior and no issues but I've heard from two others that ...

nelsona, I filed the treaty (article XXV) for 2007 (married & living in Canada, working in the US) and recently received a notice from the IRS that I owe them 2007 taxes plus interest (instead of getting a return). They recalculated my return based on an NR and totally disregarded form 8833 that...

nelsona, perhaps you can help... I went to a local tax preparer and showed her my work. She seemed to follow the pro forma / Article xxv method I used without issue. I complained about having to limit my rental losses on my pro forma and when she told me that if the income was "active" in ...

nelsona, it seems that the 1040 seriously limits the amount of rental loss one can report (form 8582, Part II), especially as adj. gross income approaches or exceeds $150k. Given this fact, it seems I'm better off filing the 1040NR. Does this make sense or are there any other alternatives? It seems ...

Unfortunately, I still have some RRSP contributions to carry forward and don't need to use any this year to bring me to zero owing in Canada. I'd hate to make the contributions only to find I don't need them.

Do you know if the 401k contributions will be able to be carried forward?
