Form 2555, Physical Presence Test and Exclusion Amount Calc

Post by Subaron »

I moved to from Canada to US on TN Status on May 18th, 2014.

From reading the instruction for Form 2555, my understanding is that I do not qualify as a Bonafide resident of Canada for the 2014 tax year (since less than 183 days in Canada for 2014 tax year).

So I am assuming I would need to file Part III instead of Part II on form 2555!?

Given that, is this the correct way to calculate the exclusion amount for the “Physical Presence Testâ€￾ for form 2555.

Notes: I was out of Canada on vacation (but not in US) for 30 days.
- 18 days between Dec 27, 2013 and Jan 15, 2014 (not including flying over international waters)
- another 12 days between Sept 3, 2013 and Sept 15, 2013 (not including flying over international waters)

330 days + 30 days away = 360 days to count backwards from May 18th, 2014 (including May 18th as a full day). Which gives me May 24, 2013.
A 12 month period starting May 24, 2013 gives me May 23, 2014
Total Days in tax year 2014 would be Jan 1st 2014 to May 23, 2014 (inclusive May 23rd), which leads to 142 days.
Finally 142/365 gives the multiplication factor of 0.389041
Exclusion amount USD $99,200*0.389041 = USD $38,592.87
