Nelsona, please share your insight with me.
I checked 1040 instruction, but it is not clear:
it says if you have refund:
1. Dual status Alien ----> Austin TX
2. US resident -------> Fresno, CA (I live in Michigan)

My confusion is still there. yes, I am US resident, but my wife (non-Canadian) is dual status alien who made a choice to join me to be treated as US resident and filing MFJ with me. We wrote a statement for that. Shoudl we send to Austin so they adjust here residency status to US resident or send it to Fresno and they can handle it (mainly because we only file 1040 at the end)

It seems that these two gentlemen who answered the query (qweryt, Mugar) have different idea about it.
Now still I am confused. I even call IRS telephtoons and they are not of much help. They didn't know the answer.

Could you please help me and tell where would you send the return with that statement ?

Thank you
nelsona

Are you doing a dual-status return or not? You're confusing the status of a person in the country versus the dual-status tax return.

As already stated you're filing a 1040 MFJ with both spouses being US residensts for tax purposes. So, you should follow the rules that are clearly specified in instructions for 1040.
