Canadian/American spouses - returns in both countries

Post by Malrothien »

Hello, everyone. I was linked these forums by members of the Visajourney community. I've browsed a bit through the threads and have found some helpful information, but would like to explain our situation here as it boggles my mind.

My husband is a CDN citizen, I am the American. I returned to the US in Jan. 2010 after living in Canada for 4 years. I have no tax liability in Canada as I did not have any income from there in 2010. My husband, however, did. He worked until March 18, 2010. He then collected EI that was taxed at NR rates from April 2010 until August 2010 when he was employed here in the US.

I am unsure where we should begin.

1) When filing his Canadian exit return, are we strictly claiming only his CDN income/EI? Or must we include the US income?
2) When filing in the US, we will be filing jointly (most likely). Should we use 2555 for his income in Canada until March, then 1116 on his EI?

Any and all advice is appreciated.

Thank you!

1. Only his Cdn income, not even including his EI, which was already taxed.
2. Yes.
