Yes, I know. I love doing Canadian taxes because that's what I'm trained to do. I only help out my Canadian clients who have some US tax issues, Thankfully it's only about 20, but it's still 20 more than I would rather have. That's why I appreciate all of your knowledge in the other situations that ...

Sale of US rental property

A Canadian senior couple have a property in Hawaii, which they bought in the 1970's. They have stayed there in the winter, and rented it in the summer. They never reported the income because the rental income was in a loss, so they didn't think they had to (ugh, where have we heard that before). The...

Recovering overpaid taxes on US pension

I am filing a 1040NR to recover overpaid tax on a US pension for a Canadian client, as they had over 15% withheld on the US pension. They have contacted their pension administrator to correct the issue going forward. I am using Taxact to prepare the 1040NR. From reading the forum, it sounds like we ...

My concern was the fact that we have already reported the income on the corporate tax return of the Canadian company. I suppose we can just reverse the income on the corporate side, and have it reallocated to her personally. Are there any issues with claiming the corresponding expenses on the US sid...

Client reassessed by IRS

I filed a personal tax return for a person who is a US citizen, who lives in Canada. In addition, her husband has a company in Canada. She is not a shareholder in the company; however, all of the work that is done by either her or her husband has been put through this company, and the company paid t...

Medicare deduction from Social Security

If a Canadian resident only has pension income, and has Medicare deducted off of their Social Security cheques, can they deduct the Medicare as a foreign tax credit, or do they have to deduct it as a medical expense. I have searched through the site for the answer, but can only seem to find examples...

In reviewing the instructions, does this mean that the current year 8891 could be subject to penalties if not filed by April 15th.

Qualifying for EITC

I have a client whose spouse is not a US citizen. They are both Canadian residents. Can she file as single on her 1040 in order to qualify for the EITC, or must she file as MFS.

Taxes withheld after TN1 Visa expired

I have a client who had a TN1 Visa for a one year contract in the US. The contract ended in October 2008. The TN1 Visa was supposed to expire at the end of the contract. He had a new contract setup after that to work in Antarctica. The company that he was working for still withheld taxes and sent th...

If he wasn't able to sell his house or rent it out, could he come back to the house for a month a year and still consider himself to be a non-resident for Canadian tax purposes. Would it make a difference if he only rented a home in the US while working, as compared to actually buying a home.

Filing 8840's

We have several clients who we file 8840's here, as we have many retired clients who go to Arizona for the winter. Has anyone heard of anybody being penalized for not filing the form though they spent the winter down south?

Seriously???? I think its an incredibly important TAX question. I don't want some hack giving me information that totally goes against what Nelson says. There's a lot of misinformation out there, and I thought Nelson might have heard of him, and could give some guidance as to whether he is a quack.

Tax presentation

I was planning on purchasing a webinar put on by Terry Ritchie from Transition Financial Advisors Group, related to tax issues on migration to and from Canada. Has anybody heard of him? Any comments whether I would likely be wasting my time and money?

Am I correct in assuming that the husband would not include taxes paid on the pension when reporting the foreign tax credit, assuming he filed MFS?
